TERMS OF USE The following Terms of Use (“Terms”) govern and apply to your use and/or reliance upon this and any website maintained by Raising Golfers, LLC (“Raising Golfers”) and any of Raising Golfer’s social media offerings (together, “Site”). Access and use of the Site are subject to the terms and conditions set forth herein, all applicable laws, statutes, and regulations and Raising Golfer’s Privacy Statement, each of which are incorporated herein by this reference. When these Terms refer to “Raising Golfers”, “we”, “us” or “our”, it means Raising Golfers, LLC. Please read these Terms carefully before using or accessing our Site. By accessing or using the Site, you are accepting these Terms, and you represent and warrant that you have the right, authority and capacity to enter into these Terms. You may not access or use the Site or accept the terms if you are not at least 18 years old. If you do not agree to these Terms, please exit the Site immediately. Raising Golfers reserves the right to add, remove or modify this Statement at any time without any prior notification. GENERAL Raising Golfers maintains this Site to provide general information about Raising Golfers and our programs. The Site is intended for U.S. audiences only. USE OF SITE By using or accessing the Site, you agree to comply with all laws and regulations applicable to the Site. You further agree not to: (a) take any action that imposes an unreasonable load on the Site’s infrastructure, (b) use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any activity being conducted on the Site, (c) attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or making up the Site, (4) delete or alter any material posted on the Site by Raising Golfers or any other person or entity, or (5) frame or link to any of the materials or information available on the Site. The Site is provided with “RESTRICTED RIGHTS”. Use, duplication, or disclosure by the Government is subject to the restrictions contained in 48 CFR 52.227-19 and 48 CFR 252.227-7013 et seq. or its successor. Use of the Site by the Government constitutes acknowledgement of our proprietary rights in the Site. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY RAISING GOLFERS MAINTAINS THE SITE AS A SERVICE TO THE INTERNET COMMUNITY. THE SITE IS DESIGNED TO PROVIDE GENERAL INFORMATION ABOUT THE SUBJECT MATTER PRESENTED. Raising Golfers will use reasonable efforts to include accurate and up-to-date information on the Site, but all information is provided “AS IS.” Raising Golfers makes no warranties or representations as to the accuracy of information presented on the Site and disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement to the full extent permitted by applicable law. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THE SITE (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), SHALL NOT EXCEED THE GREATER OF (I) $1.00 OR (II) THE AGGREGATE AMOUNT YOU HAVE PAID TO US FOR THE SITE, IF ANY, IN THE THEN PRIOR TWELVE MONTH PERIOD. THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. YOU AGREE THAT OUR SUPPLIERS, PARTNERS AND COLLABORATORS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THIS AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, THE LIABILITY OF THE COMPANY PARTIES SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. Any communication or material you transmit to Raising Golfers via the Site or Internet is transmitted by you on a non-confidential basis. Raising Golfers makes no promise, express or implied, not to use such communication or material for any purpose whatsoever, including reproduction, publication, broadcast and posting. NEWS & PRESS RELEASES The Site may contain information, news, and/or press releases, the content of which is accurate or current only as of the date of the particular information, news, press release, or posting. Raising Golfers does not update press releases once they have been made public. SOCIAL MEDIA OFFERINGS Raising Golfers may utilize social media accounts or pages from time to time. Raising Golfer’s social media offerings contain news and information about Raising Golfers and provide a place for community members to connect to learn about Raising Golfers. While Raising Golfers welcomes comments and other forms of communication related to Raising Golfer’s social media offerings, Raising Golfers does not commit to respond to any such comments or other forms of communication. Raising Golfers will manage its own social media offerings in line with social media guidelines and regulatory requirements and reserves the right to remove content that is inconsistent with such guidelines and requirements. Examples of content that may be removed include, but are not limited to, disrespectful or otherwise inappropriate postings, personal information, spam or unsolicited content, and unrelated or inappropriate information. In addition, Raising Golfers reserves the right to ban anyone from Raising Golfer’s social media offerings who violates these terms. INTELLECTUAL PROPERTY: COPYRIGHTS & TRADEMARKS The Raising Golfers company name and logo, and all product names, regardless of whether or not they appear in large print or with a trademark symbol, are trademarks of Raising Golfers, its affiliates, related companies, or its licensors or joint venture partners, unless otherwise noted. Use, reproduction, copying, or redistribution of these trademarks, without the written permission of Raising Golfers is prohibited. The entire content of the Site, including any images or text, is protected by copyright. In consideration for your agreement to these Terms, Raising Golfers grants you a personal, non-exclusive, non-transferable license to access and use the Site. You may download material from the Site only for personal, non-commercial use, and the Site may not be copied, distributed, downloaded, modified, reused, reposted, or otherwise exploited except as provided herein without the express written permission of Raising Golfers. It is the policy of Raising Golfers to enforce its intellectual property rights to the fullest extent permitted under law. The use or misuse of these trademarks, copyrights, or other materials, except as permitted herein, is expressly prohibited and may be in violation of copyright law, trademark law, communications regulations and statutes, and other laws, statutes, and/or regulations. Raising Golfers is not responsible for and does not routinely screen, approve, review or endorse the contents of or use of any of the products or services that may be offered at these websites or in such other content.
